Pharmaceutical
The members of our pharmaceutical litigation group have developed an extensive practice dealing with intellectual property and regulatory issues specific to pharmaceuticals. The litigation handled by our group includes pharmaceutical patent infringement and validity actions, pharmaceutical trade-mark oppositions and infringement and validity proceedings, court applications relating to regulatory approval of pharmaceuticals and litigation under access to information legislation. Our group has been extensively involved in representing patentees against generic drug companies in proceedings under the Patented Medicines (Notice of Compliance) Regulations.
Our lawyers represent clients in both the Common Law and Civil Law Courts in Canada, at the highest appellate levels and in both official languages. As well, we are able to represent clients not only in the Federal Court of Canada, but also in the Provincial Courts. We also have significant experience in multijurisdictional cases, not only representing clients in the Canadian aspects of the dispute, but participating in the coordination of litigation strategies worldwide.
Our pharmaceutical litigation team works closely with the members of our chemical and biotechnology patent procurement groups, all of whom have graduate and undergraduate degrees in such areas as cell biology, physiology, molecular cell biology, microbiology, immunology, biochemistry, developmental genetics, molecular and cellular physiology or pharmacy.
