Biography

Christian Bolduc is a partner in our Montreal office and practises in both official languages. Mr. Bolduc has worked in all fields of intellectual property, including patents, trade-marks, copyright, trade secrets, unfair competition, industrial designs and litigation related to each of these fields. Mr. Bolduc also counsels clients on the strategic management and exploitation of their IP assets. He has worked for clients on Canadian and foreign matters.

Mr. Bolduc’s qualifications include solid experience in the trade-mark sector. This area of his practice includes the preparation and prosecution of trade-mark applications, the preparation of registrability, availability, infringement and validity opinions as well as the drafting of co-existence agreements. Mr. Bolduc also provides assistance to his clients in complex opposition proceedings and litigation. He has developed a recognized proficiency in strategic trade-mark management, ranging from selecting trade-marks with particular value, implementing filing strategies in accordance with his clients' commercial objectives and managing important trade-mark portfolios, to setting up guidelines for properly promoting, advertising and using trade-marks, both in-house and externally. This expertise allows Mr. Bolduc to best service his clients by helping them to increase the value of their trade-marks.

Mr. Bolduc also has significant experience advising clients on commercial issues and transactions involving intellectual property, including the negotiating and drafting of license agreements and the preparation and conduct of due diligence investigations and audits of intellectual property assets.

Many of Mr. Bolduc’s clients have international business dealings and he regularly assists them in managing their intellectual property assets, particularly valuable trade-mark portfolios, world-wide. Mr. Bolduc also carries on a strong associate practice, assisting foreign agents and firms in protecting their clients' interests in Canada.

Mr. Bolduc has also represented clients in a variety of patent, trade-mark, copyright, trade secret, unfair competition and industrial design related proceedings, both before the Courts of first instance and at the appeal level of the Federal Court of Canada and the Superior Court of Quebec.  He has prepared and negotiated numerous agreements that have enabled his clients to settle their matters in an efficient and advantageous manner.  Mr. Bolduc has furthermore acquired an in-depth knowledge of special procedures, including interlocutory and provisional injunctions.

Benefiting from his scientific background, Mr. Bolduc has assisted in patent drafting and prosecution as well as in drafting patentability and patent validity and infringement opinions in various technological sectors, most notably in the biotechnology field. Prior to commencing his legal studies, Mr. Bolduc worked in a laboratory researching cellular immunology. As part of his research, Mr. Bolduc published and presented the results of his research during various international scientific seminars and conferences. During the course of his Masters studies, Mr. Bolduc had the opportunity to complete a year of laboratory work in the Oral Biology department of the University of British Columbia.

Also keen on sharing his acquired knowledge and expertise, Mr. Bolduc has been active on the lecture circuit for several years, giving numerous lectures on an array of the above-noted topics.
