Biography
Daniel S. Drapeau is counsel in our Montreal office. He practices intellectual property law, particularly patent, trade-mark and industrial design litigation. Mr. Drapeau also manages trade-mark portfolios, both for foreign rightsholders in Canada and Canadian brands worldwide. Mr. Drapeau specializes in extraordinary remedies such as injunctions and obtaining and executing preservation orders. His experience includes coordinating anti-counterfeiting programs in Canada, coordinating and conducting important seizures of evidence. More recently, Mr. Drapeau has been entrusted, by the Federal Court of Canada and the Quebec Superior Court, with the responsibility of overseeing the execution of seizure orders as Independent Supervising Solicitor. Mr. Drapeau is an experienced litigator who has appeared before the Federal Court of Appeal, the Federal Court of Canada, the Quebec Superior Court and the Trade-marks Opposition Board.
Mr. Drapeau has appeared in the Guide to the World’s Leading Trade Mark Law Practitioners, published by Expert Guides in association with Managing Intellectual Property,Best Lawyers in Canada, The Canadian Legal Lexpert Directory, and in the IP Luminaries Book, published by Informa/IP World. Mr. Drapeau has been cited, with approval, in decisions rendered by the Quebec Superior Court and the Federal Court of Canada.
Mr. Drapeau is the co-author of “Anton Piller Orders and the Federal Court of Canada” and has written extensively in the field of intellectual property, including in relation to anti-counterfeiting, trade-marks, industrial designs, settlement agreements, the protection of consumer products, fragrances, cosmetics and clothing. Mr. Drapeau has been called upon to testify before the Canadian Parliament’s Standing Committee on Industry, Science and Technology, and has been invited to address various professional and industry bodies, such as the International Trademark Association, the Association des praticiens du droit des marques et des modèles (APRAM), the Association littéraire et artistique internationale (ALAI), the Canadian and Quebec Bars, the New York State Bar Association, the Canadian Cosmetic, Fragrance and Toiletry Association, the Canadian Apparel Federation, Montreal Fashion Week and the Royal Canadian Mounted Police. Mr. Drapeau also lectures on various intellectual property topics in the context of the courses offered by McGill University jointly with the Intellectual Property Institute of Canada and at the School of Design of the Université du Québec à Montreal.
Mr. Drapeau is also frequently consulted by the media on intellectual property issues.
Mr. Drapeau is the Chair of the Anti-Counterfeiting Committee of the Intellectual Property Institute of Canada and has represented that organization at the Intellectual Property Rights Working Group of the Security and Prosperity Partnership established by the American, Canadian and Mexican governments.
